Terms of Service
These Terms of Service ("Terms") govern access to and use of the PivotMB media-buying platform available at pivotmb.com (the "Service"), operated by TryTallow LLC ("PivotMB", "we", "us", or "our"). By accessing or using the Service, you ("you" or "User") agree to these Terms. If you do not agree, do not use the Service.
PivotMB is an internal advertising-management tool used to operate advertising accounts owned or lawfully administered by its operator. Access is limited to authorized users.
1. The Service
PivotMB provides a dashboard for managing, analyzing, and reporting on advertising campaigns across connected platforms, including the Meta (Facebook) Marketing API, Google Ads, TikTok Ads, and Shopify. Features may include viewing accounts and campaigns, reviewing performance analytics, and creating or updating campaigns on connected advertising accounts.
2. Eligibility and Authorized Use
You must be at least 18 years old and authorized to use the Service. You may connect and manage only advertising accounts that you own or are expressly authorized to administer. You are responsible for ensuring that your use of the Service complies with the terms of every connected platform.
3. Account Credentials and Security
You are responsible for maintaining the confidentiality of any credentials used to access the Service and for all activity that occurs under your access. Access tokens for connected platforms are handled server-side by the Service. You must notify us promptly of any unauthorized access at privacy@pivotmb.com.
4. Acceptable Use
When using the Service, you agree that you will not:
- Violate the developer terms, advertising policies, or platform policies of Meta or any other connected platform;
- Use the Service to manage advertising accounts you are not authorized to administer;
- Attempt to access, reverse engineer, disrupt, or compromise the Service or its infrastructure;
- Use the Service for any unlawful, deceptive, or fraudulent purpose.
5. Human-Approved Publishing
The Service does not automatically publish or modify advertising campaigns. Any action that writes to a connected advertising platform — including launching, editing, or pausing campaigns — requires a deliberate, manual confirmation by an authorized User. You are solely responsible for any campaign you choose to publish or modify through the Service, including its content, targeting, budget, and compliance with applicable platform policies and laws.
6. Third-Party Platforms
The Service interoperates with third-party platforms that are governed by their own terms and policies. We are not responsible for the availability, accuracy, or actions of those platforms, and your use of them through the Service remains subject to their respective agreements.
7. Intellectual Property
The Service, including its software, design, and content (excluding data belonging to connected accounts), is owned by PivotMB and protected by applicable intellectual-property laws. These Terms grant you no rights in the Service except the limited right to use it as permitted here.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that reporting data will be accurate or complete.
9. Limitation of Liability
To the maximum extent permitted by law, PivotMB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, advertising spend, or goodwill, arising out of or related to your use of the Service.
10. Indemnification
You agree to indemnify and hold harmless PivotMB from any claims, damages, liabilities, and expenses arising out of your use of the Service, your advertising activity, or your violation of these Terms or any third-party platform's policies.
11. Termination
We may suspend or terminate access to the Service at any time, with or without notice. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (including Sections 7–10) will survive.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in that state for any dispute arising out of these Terms or the Service.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
